This is an action commenced on March 1, 1947 by Charles Tollefson, Plaintiff, against Green Bay Packers, Inc., defendant, to recover damages for breach of contract entered into on May 4, 1946. On March 22, 1947 defendant interposed a plea in abatement demanding that the action be abated until the matter in dispute had been submitted for arbitration pursuant to Paragraph 13 of the contract in question. Plaintiff moved to strike the plea in abatement and for summary judgment. The motion for summary judgment was denied and defendant granted twenty days from the service of the order upon defendants attorney to answer or demur to the complaint. Following trial, judgment of non-suit was entered on the 5th day of July, 1949 from which plaintiff appeals. Plaintiff also appeals from the order denying motion for summary judgment dated February 18, 1948. The facts are stated in the opinion.
